Refund their Diamonds balance

By accessing or using Music Promo Clippers (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Platform. These terms apply to all users including artists, curators, influencers, and content clippers.

Music Promo Clippers is a marketplace that connects independent artists with playlist curators, social media influencers, and content creators ("Clippers") for music promotion. MPC facilitates introductions and transactions between parties but is not a record label, management company, or music publisher, and makes no guarantees of commercial success, streaming numbers, or audience growth.

"Diamonds" are the platform's internal credits used to purchase submissions. 1 Diamond = $1.00 USD face value. Diamonds are non-refundable once spent on accepted submissions. Unused Diamonds may be refunded at our discretion within 30 days of purchase. Diamonds have no cash value and cannot be transferred between accounts. MPC reserves the right to adjust Diamond pricing at any time.

Artists must own or control all rights to submitted music. By submitting, you represent and warrant that: (a) you own or have licensed the rights to the submitted content; (b) your music does not infringe any third-party rights; (c) you are at least 18 years old or have parental consent. Submissions of copyrighted material you do not own will result in immediate account termination without refund. MPC bears no liability for copyright claims arising from artist submissions.

Approved curators, clippers, and influencers ("Promoters") agree to: (a) review submissions honestly and within the stated response window (7 days); (b) only accept submissions they genuinely intend to promote; (c) deliver promised placements or posts within the agreed timeframe; (d) provide genuine, constructive feedback when declining. Promoters who consistently fail to deliver or accept submissions in bad faith will be removed and may forfeit earned Diamonds.

Promoters earn Diamonds upon accepting or declining submissions per the platform's published payout schedule. Diamonds may be withdrawn as USD via PayPal subject to: (a) a 2-day hold period after approval; (b) a 5% PayPal processing fee deducted at withdrawal; (c) a minimum payout amount of 10 Diamonds ($10). MPC reserves the right to withhold payouts pending fraud investigation. Payout approval is at MPC's sole discretion.

If a Promoter does not respond to a submission within 7 days, the artist's Diamonds are automatically refunded. Clippers and influencers who accept but fail to provide proof of posting within 7 days may have the submission reversed and artist Diamonds refunded at admin discretion. MPC is not responsible for delays caused by platform outages or third-party service failures.

Users may not: (a) create multiple accounts to circumvent bans or limits; (b) submit music they do not own; (c) use bots, automation, or fake accounts; (d) harass other users; (e) attempt to manipulate payout systems; (f) use the platform for any illegal purpose; (g) reverse-engineer or scrape the platform. Violations result in immediate permanent ban without refund of any Diamonds balance.

THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY WARRANTY. MPC DOES NOT GUARANTEE THAT ANY SUBMISSION WILL BE ACCEPTED, FEATURED, OR GENERATE STREAMS, FOLLOWERS, OR REVENUE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MPC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF REVENUE OR OPPORTUNITY, ARISING FROM YOUR USE OF THE PLATFORM. MPC's total liability to any user shall not exceed the amount of Diamonds purchased by that user in the 30 days preceding the claim.

Artists retain full ownership of their submitted music. By submitting, artists grant MPC a limited, non-exclusive license to display song metadata (title, artist name, cover art) within the Platform for facilitation purposes only. MPC does not claim ownership of any submitted content. Curators and promoters are responsible for obtaining any necessary performance or synchronization licenses for their use of accepted songs.

MPC reserves the right to suspend or permanently ban any account at any time for violation of these terms or for conduct deemed harmful to the community, at our sole discretion. Banned accounts forfeit their Diamonds balance. Appeal requests may be sent to musicpromoclippers@gmail.com and will be reviewed within 14 business days.

We collect email addresses and profile information solely to operate the Platform. We do not sell user data to third parties. Payment information is processed through PayPal and is subject to PayPal's privacy policy. We use Supabase for data storage, Netlify for hosting, and Formspree for email notifications, all of which have their own privacy policies.

MPC reserves the right to modify these terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the new terms. We will notify users of material changes via the email address on their account.

These terms shall be governed by applicable law. Any dispute arising from these terms shall first be attempted to be resolved through direct communication with MPC at musicpromoclippers@gmail.com. You agree to provide MPC with 30 days' notice before initiating any legal proceeding. Both parties agree to attempt good-faith mediation before pursuing litigation.
