By creating an account or making a purchase on Music Promo Clippers ("MPC", "we", "us", "our"), you agree to these Terms in full. If you do not agree, do not use the platform.

Terms of Service

1. What MPC Is

Music Promo Clippers is an online marketplace that connects independent artists with curators, playlist managers, and content creators ("Curators"). Artists purchase in-platform currency ("Diamonds") and use them to submit songs to Curators for consideration.

MPC is a submission platform only. We are not a music label, promotion agency, publicist, or distributor. We do not represent artists or Curators. We do not guarantee any specific promotional outcome, playlist placement, social media posting, streaming numbers, plays, followers, revenue, or commercial success of any kind.

Important: Purchasing Diamonds and submitting a song does not guarantee that your submission will be accepted, listened to, posted, added to a playlist, or result in any measurable promotion. Acceptance decisions are made entirely at each Curator's independent discretion. MPC has no control over and accepts no responsibility for any Curator's decision to accept or reject a submission.

2. Eligibility

You must be at least 18 years old to create an account or make a purchase. By using MPC you confirm you meet this requirement. If you are located in the European Union or United Kingdom, additional rights and restrictions apply as described in Section 10.

3. Diamonds — In-Platform Currency

Diamonds are a virtual, non-monetary in-platform currency used solely within MPC.
Diamonds have no cash value and cannot be exchanged for real currency.
Diamond purchases are final and non-refundable once the transaction is completed.
Diamonds do not expire while your account remains active.
MPC reserves the right to adjust Diamond pricing at any time without notice.
Unused Diamonds are forfeited if your account is terminated for violation of these Terms.

4. Payments & Billing

All payments are processed by Stripe, Inc. and subject to Stripe's own terms of service. MPC does not store your card details. Prices are displayed in USD. You are responsible for any applicable taxes in your jurisdiction.

By completing a purchase you authorise MPC to charge your payment method for the selected Diamond pack. All sales are final. No refunds will be issued except as required by applicable law (see Section 9 for EU/UK users).

5. Chargebacks & Disputes

Initiating a chargeback or payment dispute without first contacting MPC at musicpromoclippers@gmail.com is considered a violation of these Terms. MPC reserves the right to permanently suspend accounts where fraudulent chargebacks are filed. We maintain full transaction records and will contest fraudulent disputes with supporting evidence provided to the payment processor.

6. Submissions & Curator Conduct

Submissions are reviewed at each Curator's sole discretion. MPC makes no guarantee of acceptance.
If a Curator does not respond within 7 days, the submission expires and the Diamonds spent are automatically refunded to the artist's balance.
Curators must not accept submissions they have no genuine intention of fulfilling.
MPC may remove Curators who maintain consistently low acceptance rates or fail to fulfil accepted submissions.

7. Prohibited Conduct

You agree not to:

Submit music you do not own or have rights to distribute
Create fake accounts or manipulate metrics
Attempt to transfer Diamonds to other accounts outside of platform features
Harass, threaten, or abuse other users or MPC staff
Reverse engineer or interfere with the platform

Violations may result in immediate account termination without refund of any Diamond balance.

8. No Guarantee of Promotional Results

By using MPC you expressly acknowledge and agree that:

MPC makes no guarantee, representation, or warranty of any promotional outcome whatsoever
Submission acceptance or rejection is entirely at each Curator's sole and independent discretion — MPC has no control over this and cannot influence it
Even if a submission is accepted, MPC cannot guarantee the quality, reach, timing, or impact of any promotion delivered
Streaming numbers, playlist followers, social media views, or any other metrics are not promised or implied by any feature or marketing language on this platform
Past acceptance rates displayed on Curator profiles are historical data only and do not represent a commitment to future performance
You are paying for access to submit your music for consideration — not for a guaranteed promotional service

Any expectation of specific promotional results beyond the above is unreasonable and not supported by these Terms. MPC shall not be liable for any loss of revenue, opportunity, or reputation arising from a Curator's rejection of your submission or failure to promote your music.

9. Disclaimer of Warranties

MPC is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or that Curators will post or playlist your music. To the maximum extent permitted by law, MPC's total liability to you for any claim shall not exceed the amount you paid for Diamonds in the 30 days preceding the claim. In no event shall MPC be liable for indirect, incidental, special, or consequential damages including lost profits or lost opportunities.

10. EU & UK Users — Digital Content & Cooling-Off Period

If you are located in the European Union or United Kingdom, you may have a statutory right to withdraw from a digital purchase within 14 days. However, by completing your Diamond purchase you expressly consent to immediate delivery of the digital content (Diamonds) and acknowledge that you waive your right of withdrawal under Directive 2011/83/EU (EU) and The Consumer Contracts Regulations 2013 (UK) once the Diamonds have been credited to your account. This waiver is confirmed at checkout. If you do not wish to waive this right, do not complete the purchase.

Nothing in these Terms removes or limits your statutory rights under applicable consumer protection law beyond what is permitted.

11. DMCA & Copyright Policy

MPC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content submitted through MPC infringes your copyright, send a written notice to musicpromoclippers@gmail.com including:

Identification of the copyrighted work claimed to be infringed
Identification of the infringing material and its location on the platform
Your contact information (name, address, email, phone)
A statement that you have a good faith belief the use is not authorised
A statement under penalty of perjury that the information is accurate and you are authorised to act on behalf of the copyright owner
Your electronic or physical signature

MPC will investigate valid notices and remove infringing content promptly. Repeat infringers will have their accounts terminated. Artists who submit music they do not own are solely liable for any resulting copyright claims and agree to indemnify and hold MPC harmless from any such claims, costs, and damages.

12. Curator & Promoter Payouts

Curators, clippers, and influencers ("Promoters") who earn Diamonds through accepted submissions may request payouts subject to the following terms:

Payouts are issued at MPC's discretion and subject to a minimum balance threshold as displayed in the portal
Payout processing may take up to 14 business days from approval
MPC reserves the right to hold payouts pending fraud review or investigation
Payouts are forfeited if a Promoter's account is terminated for violations of these Terms
Promoters are solely responsible for reporting payout income to the appropriate tax authorities in their jurisdiction. MPC does not withhold tax, issue tax forms, or provide tax advice. By accepting a payout you confirm you understand and will comply with your local tax obligations
MPC may request identity verification before processing payouts above certain thresholds

13. Dispute Resolution Between Users

MPC is a marketplace facilitator and is not a party to disputes between artists and Promoters. However, MPC may at its discretion investigate reports of:

Curators accepting submissions with no intent to fulfil them
Promoters submitting false proof of promotion
Artists filing fraudulent chargebacks after receiving promotion

To report a dispute, contact musicpromoclippers@gmail.com with evidence. MPC's decision on any dispute is final. MPC is not liable for any damages arising from disputes between users and makes no guarantee of resolution outcomes.

14. Account Termination

MPC may suspend or terminate your account at any time for violation of these Terms. You may close your account by contacting us. Upon termination, any remaining Diamond balance is forfeited unless termination was caused solely by MPC.

16. Changes to Terms

We may update these Terms at any time. Continued use of MPC after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes by email where possible.

17. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction. EU and UK users retain the right to bring claims before courts in their country of residence.

Privacy Policy

18. What We Collect

Account data: email address, display name
Profile data: platform handles, follower counts, genre preferences, bio
Transaction data: Diamond purchase history, submission records
Usage data: pages visited, actions taken on the platform

We do not collect or store payment card details — all card data is handled directly by Stripe.

19. How We Use Your Data

To operate your account and process Diamond purchases
To match artists with Curators on the Discover page
To send transactional emails (submission notifications, payment confirmations)
To detect and prevent fraud and abuse

We do not sell your personal data to third parties.

20. Third-Party Services

MPC uses the following third-party services which have their own privacy policies:

Stripe — payment processing (stripe.com/privacy)
Supabase — database and authentication (supabase.com/privacy)
Netlify — hosting (netlify.com/privacy)
Resend — transactional email (resend.com/privacy)

21. EU & UK — Your GDPR / UK GDPR Rights

If you are located in the EU or UK you have the right to: access your personal data, correct inaccurate data, request deletion of your data, object to or restrict processing, and data portability. To exercise any of these rights contact us at musicpromoclippers@gmail.com. We will respond within 30 days. You also have the right to lodge a complaint with your local data protection authority.

The legal basis for processing your data is: performance of a contract (operating your account), legitimate interests (fraud prevention, platform security), and consent where applicable.

22. Data Retention

We retain account and transaction data for as long as your account is active and for up to 7 years thereafter for legal and financial compliance purposes. You may request earlier deletion subject to our legal obligations.

23. Cookies

MPC uses essential cookies only (authentication session management). We do not use advertising or tracking cookies. No cookie consent banner is required for essential cookies.
